General terms of use 

The owner of Okitoki is the company Mardorado d.o.o. for services, Zagreb, Ulica Paškala Buconjića 19;

In terms of these General Terms of Use, Okitoki is considered, in addition to Okitoki itself, its owner, Mardorado d.o.o. for services, Zagreb, Ulica Paškala Buconjića 19 and employees, owners and responsible persons of the company;

For the purposes of these General Terms and Conditions of Use, all natural and legal persons who:

• have any form of interaction with Okitoki;

• publish their copyrighted or non-copyrighted materials - texts, photographs, documents, audio, video and multimedia works, etc. via Okitoki;

• who for any reason upload or download from Okitoki any content, information and personal information in any way.

By using Okitoki, the user agrees to these General Terms of Use, accepts and submits to the applicable substantive law of the Republic of Croatia as exclusively applicable to the interpretation, application and legal effects of all permissions, exclusions and conditions of use of Okitoki. All claims and disputes arising out of or in connection with the use of this Okitoki shall be subject to the jurisdiction of the courts of the Republic of Croatia;

All users are considered to be familiar with the terms of use and to fully understand and accept them;

In case of misunderstanding and / or non-acceptance of these General Terms of Use, the use of Okitoki is not possible;

Okitoki reserves any right to limit, change or discontinue providing Okitoki in its sole discretion without prior notice;

Okitoki reserves the right to change or amend the General Terms of Use at any time and such changes take effect on the date of publication. By continuing to access Okitoki or by continuing to use any part of the content or service of Okitoki, such changes and / or amendments to the General Terms of Use shall be deemed to have been given;

The content of Okitoki refers to kindergartens, schools, associations or companies that provide education / work with children, children of preschool and school age, their parents and employees of these organizations. Parents in Okitoki can find content shared by employees of these organizations. Content can be text, image, audio and file formats.

Okitoki is intended for adults. Okitoki does not contain such content that would be inappropriate for children. The use of Okitoki by minors is supervised by adults-parents, guardians, etc. All rights and obligations that may arise from the use of Okitoki by minors without the supervision of an adult-parent, guardian, etc. are borne by parents and / or guardians minors;

Revision of all materials and their contents is possible only for personal, non-commercial purposes and no reproduction or modification, performance and distribution or use in any way for public or commercial purposes is permitted;

A user who violates these General Terms of Use will be denied access to and use of Okitoki;

Okitoki shall not be liable for any inaccuracies and / or untruths of the information or any damage that may result from the inaccuracies and / or untruths of any information;

Okitoki also contains documents, data, information as well as links ("links") to websites created by third parties that are marked as such. Okitoki has no control over such documents, data, information or websites and does not assume any responsibility, which includes, but is not limited to, the accuracy, completeness and availability of such content. Okitoki is not responsible for any content of documents, data, information and websites created by third parties. Okitoki is not liable for any damages that may arise in connection with the content or use of Okitoki;

All publications, messages, texts, displays, photographs, video-audio works and other materials contained in Okitoki are the sole responsibility of the person from whom such content originated and Okitoki makes no warranties as to the accuracy, completeness or authenticity of such content or any other which way suits;

In the event of any third party claims against Okitoki, in connection with the content provided by the User, the User is obliged to assume all responsibility in full, take all actions and take all other appropriate actions to remove such responsibility from Okitoki and compensate Okitoki for any damage which would arise on the basis of the above;

Okitoki is not liable for any damage that may occur to the devices that the User accesses Okitoki due to viruses and other computer attacks;

Content published on Okitoki may serve as advice or guidance, but can in no way replace and is not a substitute for the advice and assessment of physicians, educators, psychologists, social workers, child education professionals, etc .;

Users are personally responsible for their interaction and communication with other Users and understand that such communication has no confidential content, so Okitoki has the right, but not the obligation, to monitor communication on Okitoki.

Okitoki reserves the right to remove the contents of Okitoki at any time without notice;

• It is forbidden to use Okitoki for the purpose of:

• own promotions;

• causing harm, intimidation or threats to other Users and / or third parties;

• incitement, favoritism and incitement to hatred or discrimination based on race or ethnic origin or color, sex, language, religion, political or other belief, national or social origin, property status, trade union membership, education, social status, marital or family status status, age, health status, disability, genetic heritage, and anti-Semitism and xenophobia, ideas of fascist, nationalist, communist and other totalitarian regimes;

• publishing, transmitting and / or exchanging content that is contrary to positive regulations, then content that is offensive, vulgar or in any other way inappropriate;

• publishing, transmitting and / or exchanging information that the User knows or must know to be false, and the publication of which could harm other Users and / or Okitoki;

• performing any illegal or unauthorized act;

• transmitting or distributing any non-legal software, including but not limited to viruses, spyware, Trojan horses, and the like;

• publishing, transmitting and / or exchanging personal data of third parties;

• sending chain letters or any other form of multiple sending of commercial or other content;

• publishing, transmitting and / or exchanging content protected by copyright and related rights of third parties;

• violation of any positive regulation.

All possible disputes arising from the mutual relations of the User are resolved exclusively between the User. Okitoki shall not be liable for any damages of any kind that may arise as a result of the User's interrelationships;

Okitoki may post links and advertisements to other websites, but is not liable for damages caused by visiting or using those websites;

By using Okitoki, the User is granted a limited, non-exclusive, non-transferable and revocable license to use the content of Okitoki by using them for personal purposes, subject to the following conditions:

the User uses the contents and services at his own risk;

The user may use the content and services only with respect to the copyrights and other intellectual property rights of their holders and Okitoki;

The user may not make any modifications to the Services without the prior express written consent of Okitoki;

on all used contents and materials, if the nature of the thing allows it, there must be visible notes on copyright, trademark, trademark, logo.

Okitoki expressly reserves and does not transfer to the User any other rights in relation to the content of Okitoki and prohibits the use of the content of Okitoki, except as provided in these General Terms of Use;

The user gives Okitoki the following guarantees regarding the content:

• that the author of the stated content, ie that he is authorized by the author or another holder of copyright or other intellectual property rights to publish such content;

• that the content complies with all positive regulations;

• that the publication of content protected by copyright or other intellectual property rights in any form will not in any way infringe the rights of third parties, including in particular copyright and other intellectual property rights, reputation, honor and dignity, right to privacy and other third party rights;

• that the use of such content on Okitoki will not cause harm, material or immaterial, to the editorial board, other users or third parties;

• that the contents are complete, true and accurate to the best of the User's knowledge.

Mardorado d.o.o. is in no way responsible for the content that users submit through the app. Users assume responsibility that the information and photo, video and audio recordings provided are true, not misleading and that the publication of the submitted information and photo, video and audio recordings will not violate or jeopardize the rights of third parties (authors of photo, video and audio records or persons found or mentioned in the said records). Mardorado d.o.o. has the right to publish such information and photo, video and audio content as part of the services provided by the OKITOKI application.

Okitoki shall not be liable for any damages that may arise due to the temporary unavailability of Okitoki, non-publication or deletion of content or error in the work of Okitoki;

Use of Okitoki is at your own risk;

These General Terms and Conditions of Use have been compiled, applied and interpreted in accordance with the positive regulations of the Republic of Croatia. All disputes that may arise or are related to these General Terms of Use are subject to the jurisdiction of the court in Zagreb.
